Welcome to My Business! These Terms and Conditions ("Terms") govern your use of our website, my-business.in (the "Site"), and our mobile application (the "App"), provided by My Business ("we," "us," or "our").

1. Agreement to Terms

By creating an account, accessing our Site, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services. These Terms constitute a legally binding agreement between you and us.

2. Description of Services

My Business provides a software-as-a-service (SaaS) platform designed to assist small solar businesses in India with administrative and bureaucratic tasks. Our services include, but are not limited to:

• Facilitating the submission of applications for net metering to concerned electricity departments (DISCOMs).

• Assisting with the preparation and submission of documents for government subsidies.

• Providing quality control checklists and forms for solar installations.

You acknowledge that My Business acts as a facilitator and intermediary. We are not a government body and are not responsible for the final approval, denial, or processing time of any application submitted on your behalf. The success of such applications depends on the accuracy of the information you provide and the discretion of the respective government agencies.

3. User Accounts and Responsibilities

• Account Creation: You must register for an account to access our services. You agree to provide accurate, current, and complete information during the registration process.

• Account Security: You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

• Your Data: You are solely responsible for the accuracy, legality, and quality of all data, documents, and information you upload to our platform ("User Content"). You represent and warrant that you have all the necessary rights and permissions to upload and share this User Content with us and, through our service, with government agencies.

4. Subscriptions, Payments, and Free Trial

• Subscription: Our services are offered on a subscription basis. Fees are billed in advance on a recurring monthly or annual basis, as selected by you. All payments are non-refundable.

• Pricing: We reserve the right to change our subscription fees. Any price changes will be communicated to you in advance and will only apply to subsequent billing cycles.

• Free Trial: We may offer a free trial for a limited period. The trial allows for the submission of one (1) net metering form and one (1) quality form. At the end of the trial period, you will be required to purchase a subscription to continue using the service. We reserve the right to modify or terminate the free trial offer at any time.

5. User Content and Data Submission

By using our service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, format, and transmit your User Content solely for the purpose of providing the services to you. This includes submitting your User Content to the relevant government departments (e.g., DISCOMs) as required to process your applications. We will not use your User Content for any other purpose without your explicit consent.

6. Prohibited Activities

You agree not to use the Site or App to:

• Upload any false, inaccurate, or misleading information.

• Violate any applicable local, state, national, or international law.

• Infringe upon the intellectual property rights of others.

• Attempt to gain unauthorized access to our systems or engage in any activity that disrupts, diminishes the quality of, or interferes with the performance of, the service.

7. Intellectual Property

All content on the Site and the App, including software, text, graphics, logos, and images (excluding User Content), is the property of My Business or our licensors and is protected by copyright and other intellectual property laws.

8. Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, that the service will be uninterrupted, error-free, or secure. We do not guarantee the approval of any application submitted through our platform. The entire risk as to the quality and performance of the services is with you.

9. Limitation of Liability

To the fullest extent permitted by law, My Business, its directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, or goodwill, arising from your use of the service or any application denial or delay by a government agency. Our total liability to you for any claim arising out of or relating to these Terms or the services is limited to the amount you paid us for the services in the three (3) months prior to the act giving rise to the liability.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Ghaziabad, Uttar Pradesh.

11. Termination

We may terminate or suspend your account and access to the services immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice before any new terms take effect. By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms.
